Terms of Use for the Services of Wash Out S.r.l.

These terms of use (the “Terms”) govern the access and use by the user (the “User”) of the services, as further described below (the “Services”), made available by Wash Out S.r.l., a company with registered office at Via Costanza 1, 20146 Milan, registered with the Milan Chamber of Commerce under REA No. MI - 2091399 (“Wash Out”), through its proprietary technology platform accessible by Users via mobile applications or the website www.washout-app.com (the “Site”), owned by Wash Out (each, an “Application”).

Use of the Services is subject to the User’s acceptance of these Terms. If the User does not accept these Terms, access to or use of the Services will not be permitted. These Terms are published on the Site to allow Users to become familiar with, store, and reproduce them.

Wash Out reserves the right to amend these Terms at any time without notice. Changes will become effective upon publication by Wash Out of the updated Terms on its Site. Continued use of the Services by the User after such publication will be subject to acceptance of the amended or supplemented Terms.

DESCRIPTION OF SERVICES

Services are provided either by Wash Out’s own specialized personnel or with the assistance of third-party providers contractually bound to Wash Out (the “Washers”). Wash Out reserves the right to modify the functionality of the offered Services or, more generally, to suspend the offer or access to the Services, in whole or in part, at any time and for any reason.

The Services primarily include on-demand vehicle cleaning (including on public roads), specifically:

  1. Exterior vehicle cleaning using specialized products, focusing on the bodywork, glass surfaces, wheels, and tire sides.
  2. Interior cleaning using dedicated products, including plastics, interior glass, fabrics, door panels, mats, and vacuuming of footwells and trunk. Personal items may be temporarily moved for cleaning and then returned to their original position. For interior cleaning, Users must open and close the vehicle themselves or via a delegate—keys are not to be handed over to the Washer.
  3. Sanitization of cabins and air filters using aerosol canisters. During sanitization, the User (or a delegate) must start the engine and set the air conditioning to maximum on recirculation mode. If this isn’t possible, the User can authorize the Washer to do so and return the keys afterwards.

To ensure proper service delivery (license plate verification, vehicle condition, quality control, etc.), Washers may take photos of the vehicle, which will only be visible to the User on the Application and never shared with third parties.

The Services may include or connect to third-party services and content (including advertising), which are beyond Wash Out’s control. The User acknowledges that such third-party use may be governed by separate terms and privacy policies. Wash Out is not responsible for such third-party content, services, or sites.

USE OF SERVICES

Account Registration

To access most features, Users must register and maintain a personal user account (“Account”). The User must be at least 18 years old (or legal age in their jurisdiction) and provide accurate personal details, including name, email, mobile number, and at least one valid payment method. Failure to provide or maintain accurate and complete account information, including a valid payment method, may prevent access to the Services. The User is responsible for all activity under their Account and must maintain the confidentiality of login credentials. Unless authorized in writing by Wash Out, each User may only hold one Account.

User Requirements and Conduct

Services may not be used by individuals under 18. Users cannot authorize others to use their Account or allow anyone under 18 to receive Services unless supervised. The Account may not be assigned or transferred. Users must comply with all laws while using the Services.

Text Messages

By creating an Account, the User agrees to receive operational SMS messages. To opt out, the User can email supporto@washout-app.com including their mobile number. Opting out may affect service usage.

Promotional Codes

Wash Out may issue promo codes at its discretion, subject to specific conditions (“Promo Codes”). The User acknowledges that Promo Codes:

  • Must be used legally and only for their intended audience and purpose
  • Cannot be duplicated, sold, or transferred unless authorized by Wash Out
  • May be disabled or revoked at any time
  • Are not redeemable for cash
  • May expire prior to use

Wash Out may deduct credits or benefits gained from the misuse of Promo Codes.

Network and Device Access

Users are responsible for their own data network access and device compatibility. Wash Out is not liable for unavailability of Services due to internet or communication issues.

Service Cancellation Due to Weather

Wash Out may cancel a service last-minute if weather conditions prevent proper execution (e.g. rain, storms, snow). The User will be informed via the contact details provided.

Cancellation Due to User Error

The User agrees to provide correct and complete information for vehicle identification and service execution. In case of incorrect or incomplete information, Wash Out may charge the full booking amount.

CONTENT OWNERSHIP

The Services, Applications, and all related content remain the property of Wash Out. Users are expressly prohibited from:

  • Reproducing, distributing, licensing, or exploiting such content
  • Reverse-engineering or decompiling the systems
  • Framing or linking any content without permission
  • Extracting or harvesting data
  • Gaining unauthorized access to the platform

DISCLAIMERS AND LIMITATIONS

Disclaimer

Wash Out provides Services with reasonable care but offers no guarantees of reliability, availability, or error-free performance. The User assumes all risks associated with the use of the Services to the extent permitted by law.

Limitation of Liability

Except in cases of willful misconduct or gross negligence, Wash Out is not liable for indirect or consequential damages, data loss, injuries, or property damage. Wash Out is not liable for:

  • Inability to access or use the Services
  • Issues with third-party providers

Users who choose to hand over vehicle keys to the Washer for certain services do so at their own risk. These limitations do not affect mandatory consumer rights.

GENERAL PROVISIONS

Users may not assign these Terms without Wash Out’s prior written consent. Wash Out may transfer its rights to subsidiaries, buyers, or successors.

If any provision is found unenforceable, it shall be modified to reflect the parties’ intent and the rest shall remain valid.

These Terms are the full agreement between Wash Out and the User, replacing any prior arrangements. Notifications may be sent via general notice, email, or mail.

These Terms are governed by Italian law.

According to Articles 1341 and 1342 of the Italian Civil Code, the User expressly acknowledges and approves the following clauses: Section 2 (Network and Devices Access, Service Cancellation Due to Weather, and Cancellation Due to User Error) and Section 4 (Disclaimer and Limitation of Liability).
